Abstract

Ziel dieser Dissertationsstudie ist es, auf einer empirischen Basis einen Beitrag zum Wissensstand in der Familienrechtspsychologie vor dem Hintergrund entwicklungspsychopathologischer Grundannahmen zu leisten. Der Forschungsstand wird anhand eines systematischen Reviews analysiert. Datenbasis für die empirischen Originalanalysen ist eine quantitative Inhaltsanalyse von 297 psychologischen Sachverständigengutachten. Es ergibt sich eine Gesamtstichprobe von N = 496 Kindern/ Jugendlichen. Die Analysen zeigen, dass die Gesamtauftretenshäufigkeit psychischer Auffälligkeiten der Kinder/ Jugendlichen in dieser Stichprobe deutlich höher ist, als allgemeine Prävalenzen. Spezifische Störungsbilder, die im Zusammenhang mit bestimmten rechtlichen Fallkonstellationen auftreten, lassen sich für die Kinder/ Jugendlichen in dieser Stichprobe nicht eindeutig herausstellen. Eine psychische Auffälligkeit der Mutter/ des Vaters treten signifikant häufiger im Kontext von Verfahren zum Entzug elterlicher Sorge auf, als in sorge- und umgangsrechtlichen Fällen. Einflussfaktoren auf die psychologischen Empfehlungen der Gutachterinnen und Gutachter im Kontext der rechtlichen Fallkonstellationen werden analysiert.

Mental disorders of children and adolescents in family law proceedings: empirical analysis of psychological evaluation reports

Aim of this dissertation study is to provide a contribution to the systematic knowledge in family law psychology based on developmental psychopathological assumptions. A systematic literature review provides an analysis of available research. The original empirical analyses are based on 297 psychological evaluation reports. The total sample consists of N = 496 children/ adolescents. The analyses show that in this sample, the overall occurrence of mental health problems in children/ adolescents is substantially higher than general prevalence rates. Significant relations of specific mental health problems in children/ adolescents to specific legal questions are not found for this sample. A mental disorder of the mother and a mental disorder of the father occur significantly more often in cases concerning parental termination as opposed to custody and access cases. Predictors for psychological recommendation making in both, cases concerning parental termination as well as custody and access cases are analyzed.
