Abstract

Die europäische Datenstrategie ist geprägt von der Idee eines neuen Datenbinnenmarktes und einer europäischen KI-Kompetenz. Kommunen müssen die kommerzielle Weiternutzung ihrer hochwertigen Datensätze entgeltfrei zulassen, um neue Technologien zu fördern. Die Dissertation stellt die These auf, dass dadurch in das verfassungsrechtlich garantierte Recht auf kommunale Selbstverwaltung eingegriffen wird, namentlich in die kommunale Finanzhoheit, in die Grundsätze der kommunalen Wirtschaftsförderung und in das kommunale Haushaltsrecht. Die Dissertation kommt zu dem Ergebnis, dass sowohl ein Recht auf Entgelt als auch eine Pflicht zur Datenbereitstellung sowie ein eigener Rechtscharakter von Daten in Abgrenzung zu Informationen notwendig sind, um eine rechtssichere Datenwirtschaft zu erschaffen. Soweit das Unionsrecht in der Normenhierarchie über dem Verfassungsrecht der Mitgliedsstaaten steht, ist die rechtsdogmatische Lösung auf Ebene des Unionsrechts zu suchen.

High-quality datasets in the European data strategy: Availability and free access in the light of (local) constitutional law

The European data strategy is characterised by the idea of a new data single market and European AI competence. Local authorities shell allow the commercial reuse of their high-quality datasets free of charge in order to promote new technologies. The thesis posits that this infringes upon the constitutionally guaranteed right to local self-government, specifically local financial sovereignty, the principles of local economic development and local budgetary law. The thesis concludes that both a right to remuneration and an obligation to provide data, as well as a distinct legal status for data from information, are necessary to create a legally secure data economy. Insofar as EU law takes precedence over the constitutional law of Member States in the hierarchy of norms, the legal solution must be provided at the level of EU law.
